I thought they were critical of Pitt for going to the ODCE, it wasn’t overt admittedly. Going on about the cost of the investigation, legal fees etc

‘Explosive’ affidavit submitted to High Court

A number of former employees of Independent News & Media whose personal data was allegedly compromised by a third-party security firm are considering taking legal action.

An investigation by the Office of the Director of Corporate Enforcement (ODCE) has identified 19 staff members whose data may have been accessed. Several journalists said they would consider legal action pending the outcome of the investigation. Some journalists had covered the Moriarty tribunal and had written stories critical of Denis O’Brien before he became the company’s majority shareholder.

The ODCE has applied to the High Court for an inspector to be appointed to the company. The case will be heard on April 16. An affidavit submitted by the ODCE is “explosive”, according to people familiar with the situation.

It is believed that legal sources connected to INM when it was controlled by Tony O’Reilly also had data accessed by the third-party IT firm.

The Sunday Times reported that an Isle of Man company controlled by Mr O’Brien paid the bill for an IT firm that was given access to the computer network of INM in 2014. The board of INM was unaware that network access had been granted to Trusted Data Solutions (TDS), which had been retained by Leslie Buckley, the former chairman of INM. Mr Buckley resigned on March 1.

The affidavit also refers to a legal action initiated in 2015 by Mr O’Brien against Red Flag Consulting, a public affairs company headed by Karl Brophy, a former INM executive, and chaired by Gavin O’Reilly, another former chief executive of INM. It is understood that Red Flag executives will seek access to the contents of the affidavit when their case against Mr O’Brien comes before the court again next week. The ODCE launched an investigation into INM after a protected disclosure made by Robert Pitt, the former chief executive of the company.

Mr Pitt made the disclosure during a dispute with Mr Buckley over the potential takeover of Newstalk, a radio company controlled by Mr O’Brien. Mr Pitt said the valuation placed on Newstalk was too high. Mr Buckley is a business associate of Mr O’Brien.

The Irish head of the National Union of Journalists is concerned about the ODCE’s claims about breaches and the data protection rights of employees of INM. Séamus Dooley, the union’s Irish secretary, has called on the company to clarify the extent to which the personal data of staff, including the confidential records of journalists, were compromised by the removal of the IT system’s back-up tapes from the company’s premises in Dublin.

Mr Dooley said: “Arising from [these] revelations there is particular concern about the threat to the confidentiality of journalistic sources. INM journalists will be worried about the suggestion that at least six companies external to their employer had access to INM data.

“The data protection commissioner must initiate an immediate investigation into this matter, separate from the proposed ODCE investigation. It now appears that previous assurances given to the commissioner by INM were based on incomplete information.

“If the High Court grants the ODCE application to have an investigator appointed to inspect the affairs of INM this month the investigation would be long and complex. I would be concerned if this delay were to be used as grounds for not engaging with staff. We will be seeking a meeting with the company and will be offering assistance to NUJ members who are concerned that their rights may have been breached.”

Mr Dooley added that it was vital that the Broadcasting Authority of Ireland monitor the situation. “Trust and confidence in the integrity of journalism is undermined when corporate interests take precedence over editorial values. Editors and journalists must be able to operate secure in the knowledge that editorial independence will never be undermined through commercial expediency.”

The Social Democrats said that the story highlighted issues of media ownership and regulation. “When Fine Gael and Fianna Fáil voted against the Social Democrats media ownership bill in 2017, the issue of control of our media was once again kicked to touch by the governing parties.” Anne-Marie McNally, of the party, said. “The revelations make it clear that we cannot continue to avoid the conversation.”

Poor auld Denny o Brine got blackguarded here, some stupid lad inside the Denny owned INM gave away all the files to some other company, also owned by Denny, and isn’t there an awful lot of stuff in the files about a hape of Denny’s auld enemies.
Poor Denny is shockingly unlucky with stuff like this.
But thank god it’s being largely ignored by the media.

He’s doing everything he can to try and eek back some of the 10s of millions he’s pumped into INM. There was obviously the neestslk deal but I see another story today where a company owned by Denis O’Brien was to receive a hefty success fee for its role in the sale of an overseas INM owned company.
