Mr OâSullivan told the jury they would see CCTV footage harvested by GardaĂ from the nightclub and other local bars and clubs âwhich will tell you what happenedâ.
âIt is the prosecutionâs case that Kyle Hayes and others pursued Cillian McCarthy outside the nightclub and that Kyle Hayes attacked Cillian McCarthy on the public street.â
Mr OâSullivan said Jai Chaudri joined Mr Hayes in assaulting Mr McCarthy, while he lay on the ground, and that Mr Cosgrave had been involved in using or threatening to use unlawful violence against Mr McCarthy, which caused the alleged victim to be in fear for his life.
Mr OâSullivan said there was no CCTV footage of the alleged attack on the street, but that two GardaĂ, who âare very important witnessesâ and who were on the scene at the time, âwill give evidence that they saw Kyle Hayes and others punch and kick Cillian McCarthy while he was down on the groundâ.
âYou will hear evidence that Kyle Hayes fled the scene and he was captured (by GardaĂ) a short time later.â
Mr McCarthy suffered a number of facial injuries including a fracture to his right eye socket.

âNone of these accused men had been under any threat whatsoever ⌠and the violence inflicted on Cillian McCarthy was totally unjustified,â the court heard.
In summing up his introduction, Mr Oâ Sullivan said: âCillian McCarthy offended Kyle Hayes by simply engaging in conversation with two girls â thatâs it, thatâs what started it all off.â
Turning to the jury, he added: âYes, you might say this was trivial, but sadly the actions of Kyle Hayes and others was not trivial ⌠There wasnât the slightest justification or the violence inflicted on Cillian McCarthy.â
The trial continues before Judge Dermot Sheehan.

He will probably get a suspended sentence or a fine Iâd say. No way those lads will get jail. His reputation off the field will be ruined obviously, but I can think of lads in worse scrapes in the 90s and nothing ever became of it.
