It’s fairly straightforward. Man enters US in 2009 and remains there. After 90 days he’s in breach of the immigration rules but is he actively getting his affairs in order - No. Is he home for his father’s funeral - again No.

I’ve no interest in the story at all but I am amazed at the lads who are suddenly experts on the topic.
Even without the facts they knew the answers.
