PS he is not condoning anything. Terry prones main thrust in that article is that character references are a perverse but ubiquitous feature of the Irish justice system, and really have no place in sentencing. She damns those who provide them by proxy.
She asks the completely understandable question at the end, what would anyone do if approached by a lifelong friend.
David Walsh is getting worse abuse as he is an unlikeable character.
Terry Prone has written an excellent article there all the same, worthy of review.

maybe. But the way Kimmage talks of Walsh but now has retweeted an article in support of him shows his true heart to Walsh. So my query is that despite all that has gone on between them and that they dont speak, Kimmage would still have his back. I just wonder, does he still have time for Humphries too? He may well not. It may also be just a simple retweet of an article. However I dont agree at all with what Walsh has done. Not just for his supporting letter for Humphries, but the fact that he is the chief sportswriter for the Times, that he is a well respected figure and that his standing would go a long way to helping someone needing a character witness statement. It wasnt just about the content, but who wrote the content that helps Humphries here. He is playing an active role in helping Humphries sentence be reduced. I dont agree with that and the talk of it being a cause of the system is brushing over the fact that Walsh could as easily refused to write a letter. The option is there for character witness testimonies, it doesnt need to be fulfilled.

And I agree. Prone is only asking the question what the reader would do, not answering it, save to say she is clearly against the whole notion of ā€œgood familyingā€ at sentencing time.

Criminal justice system is there to punish but also to rehabilitate. Character references should be viewed through that lens. Humphries has been placed into custody before sentencing. His life is effectively destroyed. He broke the law and should be punished. He will be punished. No question he walks away without a significant custodial sentence. Without seeing the letters who knows what they say.

Still and all there appears to be a massive tolerance for drink driving here in general, the situations are hardly comparable on TFK surely??

you dont think? really reads to me that Prone is saying blame the system and not Walsh and even at the end says what was he supposed to do when a friend came asking for help. I dont think that is a get out clause at all. As I said before, it wasnt just the friend in that letter, it was the reputation behind the friend that exacerbates the content.

She is only doing it to support Walsh is how I would read it and to lay off him. Iā€™m not sure Walsh is getting worse abuse than Humphries, in any shape or form. I wouldnt consider him an unlikable person, but he has gone way down in my estimation of him now.

As I mentioned earlier, the retired GAA star had the very weird stance of thinking that his history of coaching should be a mitigating factor.
