Story on the radio this morning about a man who raped his 14 year-old sister-in-law a number of times over a number of months. He would normally have been sentenced to 7 years in prison according to the judge, but because he has 2 autistic children the judge has decided it would be too disruptive to imprison him so he has received no custodial sentence.

Seems a very strange and unique logic to apply to this case. One would think that the majority of people who come before the courts for custodial sentences have some sort of family issues that might not be best helped by their incarceration. The judge referred to his autistic children as “mitigating circumstances” which is warped logic to me. They may be factors in terms of sentencing (rightly or wrongly) but they’re hardly factors that change the crime or its effects on the victim. The victim is furious with the sentence and understandably so.
