In The Courts

Why are RTE not naming George Gibney?

The extradition part wasn’t part of the restriction on the reporting of the sexual assaults/rapes, that probably only took effect once he was before the court

Is this a general law, or specific to this case?

I think it’s the general rule with cases involving sexual offences against juveniles, if not an actual law. The injured party can then waive his/her right to anonymity and identify the accused at the end of the case

@ChairmanDan might clarify

All sexual assault cases are heard in camera with reporting restrictions. In the event of conviction, the victim, if not a minor, can waive anonymity in terms of identity of the abuser and their own identity as well.

Fuck sake.

Niall Gilligan found innocent of batin the young lad

That is quite remarkable. He’d have seen jail on the mainland

Did I read the young lad was getting pushed around in a wheelchair after the incident?

Ten grand for a drunken attempt at a kiss and nowt for hospitalisation of a 12 year old with a plank.

A lot of people would have sympathy for a fella having to deal with feral youths.

Not followed it closely, but didn’t it hinge on whether it happened inside or out. He’s obviously convinced them he didn’t see who he cracked.

A wheelbarrow

Not taking a plank to a 12 year old.

He felt threatened for his life by two pre teen kids who were trying to run away.
Or he was mithered and snapped.

That was the legal defence that was put up.

Juries apply common sense though. @Fagan_ODowd has summed it up quite succinctly there as to what was most likely the real rationale in the jury deliberations and verdict. The 3 points in the 1997 All Ireland Final in a 1 point win over Tipperery probably didn’t do any harm either before a jury of his Clare peers.

Stitch in time and all that

Fellas reading court reports never see what a jury sees.
