Two High Court challenges are under way against a Greenway planned for Co Kerry.

The 32km South Kerry Greenway for cycling and pedestrians will run between Glenbeigh and Caherciveen, mainly along the former disused Southern and Western Railway that operated from 1892 to 1960.

In the first action, James Clifford, a local farmer, and Peter Sweetman, an environmental activist, are seeking permission to challenge An Bord PleanĆ”laā€™s decision last November to approve Kerry county councilā€™s application for the greenway, which includes a three-metre wide paved surface.

The applicants, represented by Margaret Heavey, BL, claimed that the planning boardā€™s decision was invalid because it contravenes various EU directives on environmental impact assessments (EIAs) and habitats. They also claimed that it failed to take required steps to establish a system of strict protection for the Kerry slug and the Lesser Horseshoe bat in their natural range.

The judicial review has been taken against the planning board, the state, and the attorney general. It seeks to overturn the boardā€™s decision.

They also seek a declaration that a section of the 2000 Planning & Development Act does not comply with the stateā€™s obligations under the EIA directive, claiming that the state has failed to transpose into Irish law an obligation to determine if a road should be made the subject of an EIA.

A second challenge has been brought against the boardā€™s decision by members of a group representing local landowners, called the Greenway Information Group, whose properties are be used as part of the greenway. Their lands are to be acquired by way of compulsory purchase orders.

The group, represented by Michael O Donnell, BL, are also seeking orders from the court quashing the councilā€™s decision to grant permission for the greenway.

Kerry county council are the notice party to both actions. Both cases were briefly mentioned before Mr Justice Charles Meenan yesterday, who deemed them formally opened. The judge then adjourned the cases to later this month.

The applications for permission to bring the challenges were transferred to the High Courtā€™s strategic infrastructure development and commercial planning list, which is managed by Mr Justice Richard Humphreys.

No, still 2km left and itā€™ll be a fully cross border one (until the border is gone hopefully) then. You could go the whole way into Newry on it. The funding is there for it, and itā€™s ready to go I think.

The long term plan of running one the whole way from Dundalk to Carlingford and onto Newry will be amazing if it happens

Booked for a week up there in August. Can extend to 10-12 days or so. Whatcha reckon? 3 couples and 7 kids. Green way, skypark, avtuvites centre, hillsā€¦etc anything Iā€™m missing? Worth extending?

Is it Carlingford ye are staying in? A week is more than enough I would reckon tbh. If ye are outdoorsy and the weather is good, thereā€™s a nice bit to do. Lots of hiking options. Kayaking. Water based stuff. You could spin down to Greenore and get the ferry across and zip up the Mourne Coast for a day too.

Carlingford is a small enough place itself (some good food options about though) and can get a little overrun with stags and hens at weekends if things are back in hill swing by then
