Itās hard to see how the state is liable here - surely liability only arises if they are somehow negligent in terms of training, equipment etc. Does liability automatically arise the minute a guard sustains any sort of injury? What was the state meant to do - provide him with a bodyguard? Surely the states protection off off-duty guards comes in the form of enforcement of laws protecting them and it canāt do more than that? Why isnāt he suing the perpetrator who clearly is liable?
Any member of the force injured in the line of duty is entitled to sue the minister for justice as far as I know. This may extend to off duty personal who deem a situation dangerous enough to get involved in. By claiming he was assaulted because he is a guard is the same as if the same lad called up to his house and thumped him when he was off. I.e. it is irrelevant where the assault took place
