Theyā€™re not actually required by law. But everyone has a right to leave a contract. Then there is arbitration to determine the cost to the player of leaving his contract. So they put the clauses in because itā€™s more beneficial for everyone if the fee is already set. The club that owns the player gets to set a premium price. The player gets to leave immediately, rather than waiting for a court case to be settled before he can leave.

Sevilla have been exploiting this in recent seasons by not paying on transfer condition fees when players activate their release clauses because itā€™s not a normal transfer, itā€™s a payment to the player of the cost to him of leaving his contract.

When they ā€œsoldā€ Keita for his release fee to Barcelona, they didnā€™t pay the agreed % to Lens, his previous team, arguing they never sold him.

5pm tomorrow mate in England. They brought it forward this season as English clubs were peeved with players moving after the season started.
