A JURY has been sworn in at the circuit criminal court trial of a 22-year-old man accused of dangerous driving causing the death of a father of four.
Shane Fitzgerald of Upper Knockeen, Knockduff, Meelin, Newmarket, Co Cork, is charged with dangerous driving causing the death of Paudie O’Leary (42) at Scrahanfadda, Gneeveguilla, Co Kerry on July 1, 2012.
Mr Fitzgerald has pleaded not guilty.
The trial before Judge Thomas O’Donnell is expected to hear from over 140 witnesses from a number of jurisdictions, including Australia, and will last over two weeks, the jury has been told.
Among the witnesses will be members of the O’Leary family, including Mr O’Leary’s widow, Margaret, and his brothers and two sisters.
It will hear from police witnesses from Australia and the UK as well as garda witnesses.
Representatives from Toyota and ferry companies, P&O, Stena Line and Irish Ferries will also be called.
Prosecuting counsel Tom Rice said it is alleged Mr Fitzgerald’s dark grey Toyota Landcruiser was involved in a collision with a bicycle at 5.15am on July 1, 2012.
He said Paudie O’Leary died as a result of the collision and the vehicle did not stop or remain at the scene.
Mr O’Leary’s widow, his eldest daughter, Shannon, and members of their extended family are in court for the trial.
Worth adding to the above that i heard on the news and some of which was not mentioned in the article:
- The day after the victim was killed, the accused got the ferry to England and from there he went to Australia. He had not returned since until called home for the court appearance.
- The jeep he had in Ireland and was driving that night has disappeared.
- On the night in question the accused was boozing in the town and ended up in the residents bar of a hotel until leaving after 4am. He is accused of having driven down the wrong side of the road when he hit the victim, driving him some distance through or over a ditch and into a field.
- The accused is from Cork.
