Well actually the perception was that the 2010 case was. You have the mother saying he was this adorable & doting father. Yet he got sent to jail and was locked up in the nonces wing.

They then launch a long campaign to get their child back. For some judge with probably romanticised notions of the nuclear family that impacts.

Yeah he had a couple of other convictions but that’s not uncommon for a working class English male.

Through the judges eyes he was probably failed in life and deserved another go.

The judge was applying the typical little Tory agenda of pushing back against big government and social services in particular. There has been a concerted campaign in the Tory media and Tory circles demonising social services for decades now.

The only one left completely innocent in all of this (bar the victim)appears to be granddad who could have done no more. Poor man. What a sick story

No. What will have happened is that plenty of experts will have said the injuries were inflicted, but some hired gun quack will have said otherwise for cash.

I doubt she will give a shit Tim, I really do. If she did, she would resign. She won’t.

I thought she is now retired but could be wrong. Social Services in this country,well Birmingham anyway, is awful. Low pay, over worked and over stretched. It’s impossible to get anything sorted. they can be infuriating to deal with at times but I do have a bit of sympathy for them.

@Fagan_ODowd is overegging blaming this entire thing on the tory party, but he is dead right, the hoggs and their ilk will happily put this little speed bump behind them unless it personally inconveniences them in some way.

They did their best, and were proven correct in this case.

It was a private social services firm

The local and public one sided firmly with the grandparents. The judge ordered that it be changed as it was deemed that there was a breakdown in trust between the parents and social services.

She retired 6 days before the trial.

I can’t imagine why there might have been a breakdown in trust.

I haven’t fully read up on her background of cases. I’m not willing to go out there and say what an evil Tory bitch. I think she was incompetent and obviously biased in one direction but that doesn’t mean she was callous, just because of her own background.

There were certainly factors surrounding this (overturned conviction, mother firmly siding with the father, media campaign led by Max Clifford) that would lead to bias. It is unacceptable though and professionally unforgivable.

The Guardian have a piece calling for more openness from family courts. We can see from the media campaign for him how easily things can be twisted. Just read the below from a local paper the time they got her back, it will undoubtably lead to bias;

"FIVE years ago doting dad Ben Butler saved his baby daughter’s life when she stopped breathing – and soon found himself in JAIL.

After clearing tiny Ellie’s airway, Ben rushed her to hospital, where doctors found head injuries similar to those caused when a baby is shaken.

He had to stay on a wing full of PAEDOPHILES — and share his cell with a convicted child abuser.

I don’t agree. There was plenty of foresight in that. Some hired quack has blood on their hands as much as anyone here.
I dont think antagonistic medical evidence should be used. There should be a commissioned medical report by a vetted, neutral, appointed expert or experts giving balance of probabilities from known studies. That is all.
The meeja always shriek “proven innocent”, when “not proven guilty” would be far more accurate.
This cunt was guilty from day one, and obviously so, much like other high profile “proven innocents”

Im not blaming the entire thing on the Tory party. I am however implicating the British caste system that continually projects individuals like this into positions of power regardless of ability. This lady, despite being a high court judge, never studied in University. She did however get an honorary degree in law, from the University of Westminster, a university founded by her great grandfather.

After a brief hiatus triggered by the social chaos of the two world wars the British aristocracy have reasserted their position in society and set about dismantling what’s left of the the welfare state. The denigration of social services, is but a part of this process. There has been a very pronounced counter revolution in the UK over the last thirty years. Brexit would put the tin hat on it.
