A three-times married pensioner paid €6,000 for a fake French ID card to secure the unlawful entry into the State of a then 20-year-old Moroccan woman he met on a dating website, a court has heard.

At Ennis Circuit Court yesterday, Roger Bishop avoided jail after the judge imposed a suspended 20-month prison term.

Judge Francis Comerford said the 76-year-old “had engaged in serious offending” for assisting in the unlawful entry into the State at Dublin Airport on March 1, 2024.

The pensioner’s lawyer Kenneth Kerins said his client’s unlawful actions in bringing the woman into Ireland through a false French ID “were borne out of desperation and loneliness”.

The pair met on legitimate international dating website lovehabibi.com and the lawyer said Mr Bishop “was looking for a relationship and someone to take care of him”. The age gap between the couple is 54 years.

Mr Kerins said that Mr Bishop, a UK national who has lived in Ireland for more than two decades, has already been married three times and was going through a divorce with a Tunisian woman around the time of committing the offence before the courts.

He told the court that Mr Bishop, of Little Thatch, Crown, Lissycasey, Co Clare, “seems to be unlucky in relationships”.

He said his client went through a contentious martial breakdown after arriving into Ireland in 2002 with his then wife and two daughters now both aged in their 20s and living abroad.

Investigating Garda in the case, Det Garda Karen Barker from the Garda National Immigration Bureau agreed with State Counsel, Sarah Jane Comerford that the “tenor of the WhatsApp messages was that there was a romantic relationship between Mr Bishop and the woman”.

Det Garda Barker said the woman – now 22 – declined the option of providing a victim impact statement to the court.

Mr Kerins told how after linking online the pair decided to meet and Mr Bishop – 74 at the time – travelled out to Morocco and they spent some time there “and she agreed to travel to Ireland through the sourcing of the false French ID card”.

Mr Kerins said the messages show that “it was hopeful at the beginning and they seemed to be getting on and both parties were excited about her arrival”. Det Garda Barker said the two came to Ireland on March 1, 2024 in a flight from Istanbul, Turkey.

Mr Bishop bought tickets and a French ID card and assisted the woman in travelling to Dublin Airport where he presented his passport and the French ID card with her details on it and gained entry.

On arriving back in Clare, Mr Bishop assisted the woman with securing a PPSN number and a 20-hour per week restaurant job.

However, Ms Comerford said that after successfully returning from a trip to Frankfurt on May 29, 2024 on the fake French ID to meet friends, the woman realised then she didn’t want to remain in the company of Mr Bishop.

The woman travelled to Luxembourg the following month where authorities determined the French ID was fake and she was sent back to Dublin.

Det Barker said the woman then applied for asylum here, has been refused and continues to reside here.

The woman (19) did not know Sousa - and he used Google translate on his phone so the frightened victim could understand his demands.

He repeatedly slapped her in the face during the prolonged ordeal and warned her to shut up when she realised he was making video-recordings of the assault.

Sousa was living in the west Cork area for around18 months before the rape occurred on March 29, 2024.

He was previously a professional footballer in his native Brazil.

Sousa played for America Mineiro, a Serie 2 team based in Belo Horizonte in the Minas Gerais province.

He pleaded guilty before Ms Justice Siobhan Lankford at the Central Criminal Court to the rape.

Ms Justice Lankford imposed a nine-year sentence as she warned it was an horrific attack on the young woman - and praised the 19-year-old for the courage of her victim impact statement.

The judge said the victim had displayed great courage and eloquence in explaining what had happened.

Ms Justice Lankford described it as a very serious offence.

She noted a number of aggravating factors including the involvement of a weapon, the fact the attack occurred in the woman’s own bedroom, its prolonged nature and the great age difference between Sousa and the victim.

The judge noted the various methods of sexual assault inflicted on the woman throughout the ordeal.

“These events were videotaped. He made a video of her private parts - this is all hugely aggravating.”

Ms Justice Lankford noted that Sousa had a good work history and that he had entered a plea in the matter.

She also accepted that his remorse over what happened was genuine.

Ms Justice Lankford agreed to backdate the sentence to March 29, 2024 when Sousa was first taken into custody.

The young woman admitted the appalling attack has left her terrified of physical contact.

“No matter how many showers I had it felt like his fingerprints were on my body permanently - if someone was to touch me, even a hug, it terrified me,” she said.

Details of the attack were outlined by Detective Garda Áine O’Regan of the Garda Protective Services Unit.

Sousa had gained access to the woman’s bedroom around 7am that day.

“He then held a knife to her and raped her on numerous occasions that morning,” she said.

“She woke to find him leaning over her in her bed at 7am. He had a knife in his right hand. He covered her mouth with his left hand. He told her to shut up or he would kill her and her mam and her dad. He had the knife in the air moving it back and forth. The blade never touched her. He was on top of her.”

“She knew something bad was going to happen. She decided to trick him to leave her alone – she agreed to have sex the following day. But he kept slapping her in the face and said: ‘No, you are going to do it now.’ She agreed to give him oral sex. He was still holding the knife.”

Sousa then raped the woman.

He made repeated death threats and recorded some of his activity on his mobile phone.

“When she said: ‘No video’ to him he told her to shut up. He slapped her on the face because he believed she was not showing pleasure…(but) he kept apologising to her. He said he was studying Irish law and had proof that she was enjoying it,” the detective said.

Sousa also used Google translate on his phone to ensure the 19-year-old could understand him.

He warned her she could not tell anyone he was going back to his native Brazil.

GardaĂ­ later discovered he had his bags packed and a ticket for a flight to Brazil the following day.

A return flight to Ireland was booked for a month later.

The victim said that, when he left her house, she could hear the man weeping.

She climbed out her bedroom window to raise the alarm as she was worried her attacker might still be nearby and could spot her leaving by the front door.

The woman alerted a friend and her friend’s father with Gardaí immediately informed of the rape and sexual assault.

GardaĂ­ were able to identify the attacker and Sousa was arrested a few hours later.

An examination of his phone revealed he had a number of relevant videos.

The victim said she was attacked in the very place she was supposed to be able to feel safe with the assault taking a terrible toll on her.

“It started off as me not wanting to be in school and pretty much around people, to sleepless nights, constant nightmares that I still remember and still have. I have a fear of being alone (in her house). I couldn’t sleep alone for a long time or without a background noise.”

“I began going to therapy, hoping it would help my trauma, but it didn’t, it was just more of a reminder. I have (self-harmed) because it felt like his fingerprints were still there and because that would numb the pain I was feeling on the inside but that didn’t help either.”

“Other days I was fully convinced I should have died that day by being stabbed and it would go into an instant panic attack from the thought of it.”

“When he gets out of prison eventually he will be able to get on with his life but this will stick with me forever and will always be in the back of my mind.”

“He done this in the place that was supposed to be my comfort space and safe place but he completely ruined it for me. That was the house I grew up in and now it is in my nightmares. No one should ever have to fear for their safety in their own home.”

She directly addressed her attacker.

“I hope you realise how serious this crime is and how much it can really destroy someone’s life. I hope you never forgive yourself or forget how much your actions have affected someone. I hope you never feel okay or comfortable with yourself ever again.”

Shocking- the judge was busier trying to accumulate reasons why she could shorten the filthy dangerous sick bastards sentence than seeing ways for which he should never breathe freedom again.

That dirtbag will be out in 5 years. The damage to the girl and her family a lifetime sentence.

Where’s the outrage? I notice that the independent didn’t even cover the 1 year reduction of sentencing. Why?

I know there shouldn’t be any levels to how bad am assault like this is but this girl was in her own bed…minding her own business…no sense at all now he happened to land into her house was he living nearby etc

I have a putter alongside the bed I am only waiting for the day some fella comes on the front door to.rob the telly
