Taking on an employee

don’t sign new agreement. It gives you more options. Current place may counter offer.

Don’t resign. Say you have received a very good offer you are thinking of accepting but wanted to say it to them first out of courtesy. Give them 24 hours. Then sign other agreement. Then resign. Don’t need to let new employer know what you’ve done.

How legally binding is signing the new agreement though?

They could try and force you to work for your notice period under it. It also looks bad if you want to go there in future.

It’s more Most people once they sign won’t entertain a counter offer - moral more than legal thing.
