There is an argument over whether the Fitzgerald surplus should be distributed. That’s Andrews trying to have his cake and eat it. The same principles apply; if it’s being run as a 4-seater then you don’t distribute the surplus unless it decides the top 4, not the top 3. It’s been run as a 4-seater so the counting stops after Gannon is distributed and that’s that.

It doesn’t make sense for Andrews to proceed with any challenge now. The only possible grounds really would be to argue that Cuffe and Fitzgerald have been elected without having reached the quota for a three-seater; in turn however it would follow that the Boylan elimination is correct.

They shouldn’t lose hope just yet in the Law Library. No doubt there’s a citizen out there who will challenge the validity of the entire national result on the grounds that Dublin and South are now under-represented and MNW over-represented in terms of MEP per head of population.

It’s possible but by no means likely that Andrews could have got seat 3 if the count had been run according to it being a three seat constituency, with a quota of 90k

A lot of the transfers of White and Gannon would have gone to Cuffe and Fitzgerald

But Boylan’s transfers would have almost certainly won seat 3 for Daly anyway - and as it was, she had been closing all along before counts 14 and 15 when Cuffe and Fitzgerald were taken out of the equation
