I presumed before that civil servants (at a certain level?) were contractually meant to be apolitical but there seems to be an assumption today that general legislation trumps an employment contract

If he were claiming to speak on behalf of the BBC then different issue as an employer can stipulate employees are non political when on air. If he can’t criticize the government or government policy in a private capacity, then there is no free speech.
