If you’re reckless as to whether you cause an outcome, you should be fully responsible for the consequences.

The charge relates to the outcome. If she just mounted the footpath and hit the gate of the creche it would be a lesser charge with less severe penalties. The more serious the consequences, the heavier the penalty.

So, blind luck in other words, dictates the severity of the prosecution.

Same as most everything else. If you throw a punch and end up killing a fella it likewise comes with heavier penalties
