I didn’t know that but even allowing for previous it was excessive, especially when you look at the Irish justice system’s apathy towards white collar crime. There’s a considerable disparity between 5 years for tax evasion and suspended sentence for a sex offender.

I don’t think Nolan was wrong in the garlic case. it had been going on for years and was a willful breach of the law.
the Court got it very wrong in the lyons case and even the CCA didn’t get it right on appeal. should have been a lot more jail time with very little of the sentence suspended

5 years wouldn’t have been excessive if it was being applied consistently. I imagine he kept doing it because he and others were getting away with it. Doesn’t make it right but to turn around and give him 5 years when you see the lack of convictions post Celtic Tiger crash for people that bankrupted the country, the sentence was excessive, inconsistent and unfair.
