Any serious negotiator would have been able to talk themselves out of the mess Hogan found himself in. Instead Big Phil was forced to resigen

No he doesn’t and Clarke gave his personal opinion to that end. But 66% of the oireacteas decides his actions amount to stated misbehaviour then he’s gone with no recourse

Its the checks and balances and the seperation of powers that make Ireland the free country it is

Hopefully sense prevails in Leinster House and they don’t seek a remedy not sought from members of the Oireachtas who attended the same event and retained their seats.

I felt at the outset that the biggest problem for Woulfie with all of this was if there were breaches of the separation of power provisions. Former Chief Justice Denham explains it all very succinctly in her report and confirmed that there was no breach of the separation of power provisions in the Constitution by Woulfie in attending the dinner. That should have been the end of the matter.

It seems to be a case now that the other judges of the Supreme Court don’t want to work with Woulfie and are telling tales back to the Oireachtas to that effect. Is that not the judiciary in disrepute of the separation of powers provisions? Parliament and the Executive appoint judges, not the judiciary. The rest of the judges just have to get on with whoever is appointed.

Also her taking of woulfies explanations at face value is bewildering.

Woulfes comments in his chat with denham would have him recusing himself from any case involving media and he’d have to recuse himself from any lockdown cases.

There was a quick and easy way out of this and woulfie didn’t take it. Now he finds himself facing impeachment with noone to blame but himself.

In a way it’s right that the oireacteas have to solve this problem given that they failed to enact the judicial council

It’s a pity that woulfie wasn’t in the HC and facing Peter Kelly as president of the HC

According to Phoenix the other week, Woulfie was part of a triumvirate that opted for Frank Clarke as Chief Justice over Peter Kelly. I thought Peter Kelly retired as President of the High Court a few months back after hitting retirement age?

I think Kelly took retirement after he didn’t get CJ. Judges can continue after 65 subject to health checks if they got the be ch before 2001 IIRC

He retired during the summer when he turned 70.

Actually it was 1996 on the be ch but Kelly could’ve served until age 72
