Well in one case we can isolate a 47% vote and say that it is not evidence of a mandate and in the other we can make all manner of supposition to render a 38% vote an immutable mandate.

You are equivocating a 38% turnout vs a 47% percentage of a vote. They arenāt the same.
It was 16 vs 17 unopposed constituencies. There was a clear mandate for the Treaty from the people of Ireland.
